Terms and conditions of sale

1. Subject matter of the online contract and its definition.

An online sales contract refers to a distance contract, i.e. a legal transaction concerning movable goods entered into between Sweet Land di Fioraso Jonata & C. Sas (hereinafter referred to as MADAMATORINO.it) through the MADAMATORINO.it Shop. The following are the terms and conditions of sale, which will remain in effect until changed by the supplier. Any changes to the terms and conditions of sale will be effective from the moment they are published on the website www.MADAMATORINO.it, and will refer to sales made from that moment onwards.

2. Place an order.

To place an order, you must be of legal age and reachable by telephone. You can place an order by filling out the order form available on the website www.MADAMATORINO.it after registering or creating your personal account. If this is not possible, orders will be accepted by email at info@dolcezzealbino.it, provided they are complete with all the details of the products requested and contain the tax information necessary to process the order. As soon as we receive your order, we will notify you of its acceptance by issuing an Order Confirmation, which will be sent to you by email. The Order Confirmation will be effective upon sending. If the order is not accepted, we will contact you by email or telephone. Although we will do our best to supply the products indicated in the Order Confirmation, we may not be able to supply these products for reasons beyond our control. In this case, we will contact you to inform you and offer you alternative products that you can purchase. If you decide not to accept our proposals, we will cancel your order for the products we are unable to supply and the amount relating to your order will not be deducted from your account.

3. Sales prices and terms of purchase.

Prices are subject to change at any time without notice, as they are susceptible to market conditions. All sales prices of the products displayed and indicated on the website www.MADAMATORINO.it, which constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, are inclusive of VAT and any other taxes. the cost of transport is duly highlighted on the relevant page of the website or at the time of purchase in the shopping cart, which you should check before confirming your purchase; in the case of delivery abroad, you will be responsible for any additional costs due to taxes or duties provided for by the legislation in force in the country of destination. The purchase contract is finalised by accurately completing the form and consenting to the purchase by accepting the terms and conditions online. You can pay for the goods ordered using the payment methods indicated online at the time of purchase.

4. Contract execution and delivery methods.

MADAMATORINO.it will deliver the selected and ordered products to you, in accordance with the procedures set out in the previous article, using trusted couriers and/or shippers. If you are absent at the time of delivery, a notice will be left and you must personally contact the courier or shipping agent as soon as possible to agree on the delivery methods, bearing in mind that all additional costs due to delayed delivery will be your sole responsibility. However, no liability can be attributed to the supplier for delayed or non-delivery attributable to force majeure or unforeseeable circumstances.

5. Product availability.

You can purchase all the products listed in the electronic catalogue available on the website www.MADAMATORINO.it. If an order exceeds the quantity available in stock, it will be processed when the products are available in the requested quantity, unless otherwise agreed with the sales department, no later than thirty days from receipt of the order.

6. Our responsibilities.

MADAMATORINO.it assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed time frame. MADAMATORINO.it shall not be liable to any party for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above. Similarly, MADAMATORINO.it is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards, cheques and other means of payment when paying for the products purchased. MADAMATORINO.it is not able to know the buyer's credit card number at any time during the purchase process, as it is transmitted directly to the PAYPAL service provider via a secure connection. Similarly, MADAMATORINO.it is unable to check the correct and lawful origin of the credit instrument delivered by the Customer upon receipt of the goods.

7. Obligations of the purchaser.

Once the online purchase procedure has been completed, you undertake and agree to print and retain these general terms and conditions, which you will have already viewed and accepted as a mandatory step in the purchase process, as well as the specifications of the product purchased, in order to fully comply with the conditions set out in Articles 3 and 4 of Legislative Decree No. 185/1999. 7.1 It is strictly forbidden to enter false and/or invented data in the registration procedure necessary to activate the process for the execution of this contract and related further communications. Personal details and email addresses must be exclusively your own real personal data and not those of third parties or fictitious data. It is expressly forbidden to make double registrations corresponding to a single person or to enter data belonging to third parties. MADAMATORINO.it reserves the right to take legal action against any violation or abuse, in the interest and for the protection of all consumers.

8. Authorisations.

By filling in the appropriate space on the website, you authorise MADAMATORINO.it to use your credit card, or another card issued in its place, and to debit your current account in favour of Sweet Land di FIORASO JONATA & C. Sas for the total amount shown as the cost of the purchase made online. The entire procedure is carried out via a secure connection directly linked to: PayPal (Europe) S.a r.l.
